The 2018 Farm Bill
The 2018 Farm Bill authorized the widespread production and commercialization of hemp derived products (including CBD oils, compliant THC gummies, and other products) on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.
This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC on a dry weight basis, and the source of THC must be industrial hemp.
Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 gummies are legal on a federal level but illegal in a number of states.
The 2018 Farm Bill gives states the authority to submit plans to the United States Secretary of Agriculture in order to have primary regulatory control over the production of hemp within their borders. New Hampshire House Bill 459
Following the Agricultural Act of 2018 ("2018 Farm Bill"), which legalized CBD and hemp production nationally by removing hemp and its derivatives (Cannabis sativa-L containing no more than 0.3% THC) from the Controlled Substances Act, New Hampshire chose to legalize the production and sale of certain hemp-derived THC and CBD products.
In July, 2019, Governor Chris Sununu signed House Bill 459-FN into law which legalized the growth, production, and transportation of industrial hemp in the state. The bill brought New Hampshire's hemp program in line with federal law as part of the 2018 Farm Bill.
HB 459-FN requires any grower, processor, or commercial trader of hemp to apply to the United States Department of Agriculture for a license. Licensed Hemp Growers may legally cultivate or grow hemp crops, whereas Licensed Hemp Processors/Handlers may receive and possess hemp harvests for the purpose of processing into "publicly marketable hemp products," such as seed oil or CBD oil.
Medical Marijuana in New Hampshire

The bill was considered one of the strictest medical marijuana bills in the US, permitting cannabis only after all other therapeutic options had been attempted.
Governor Hassan also modified the law to prohibit patients from cultivating their own cannabis. Patients with qualifying medical conditions can register with the state Department of Health and Human Services to possess up to two ounces of cannabis at a time under.
According to New Hampshire state regulations:
- Patient possession limits: two ounces.
- Reciprocity: a “visiting qualifying patient” with a valid registry card can purchase cannabis in New Hampshire. A “visiting qualifying patient” will not be permitted to purchase cannabis more than three times in a 12-month period absent a statement from his/her health care provider. The state is currently working toward creating a system to serve out-of-state patients in New Hampshire.

Industrial Hemp Plan
Sec. 439-A:2 Definitions.
- "Cannabidiol" or "CBD" is a phytocannabinoid extracted from hemp plants.
- “Hemp products” means all products made from hemp, including cloth, cordage, fiber, food, fuel, paint, paper, construction materials, plastics, seed, seed meal, seed oil, and certified seed for cultivation.
- “Hemp” means the plant Cannabis sativa L. and any part of the plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration (THC) of not more than 0.3 percent on a dry weight basis.
Sec. 3 Controlled Drug Act; Marijuana; Hemp Exception.
Amend RSA 318-B:2-c, I(a) to read as follows:
(a) "Marijuana" includes the leaves, stems, flowers, and seeds of all species of the plant genus cannabis, but shall not include the resin extracted from any part of such plant and every compound, manufacture, salt, derivative, mixture, or preparation from such resin including hashish, and further, shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks, fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination. Marijuana shall not include hemp grown, processed, marketed, or sold under RSA 439-A.
Sec. 4 Therapeutic Cannabis; Industrial Hemp Excepted.
Amend 126-X:1, III to read as follows:
III. "Cannabis" means all parts of any plant of the Cannabis genus of plants, whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, salt, derivative, mixture, or preparation of such plant, its seeds, or resin. Such term shall not include the mature stalks of such plants, fiber produced from such stalks, oil, or cake made from the seeds of such plants, any other compound, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seeds of such plants which are incapable of germination.
In other words, similar to the Farm Bill specifications, Delta 9 THC products can be sold in New Hampshire if they meet the following criteria:
- Delta 9 THC in the product is derived from hemp
- The product contains 0.3% or less of THC by dry weight
